01Who we are and what this policy covers

FloGames is a brand of Transcendix Partners LLP, registered in India (LLPIN AAC-1484), with its registered office at No. 8/2, Novel Office Central, Ulsoor Road, Bengaluru, Karnataka 560042, India ("FloGames", "we", "us").

This policy explains how we handle personal data when you:

• visit flogames.com (the "Site");
• book a demo, leave your email with us, or contact us; or
• play our games on Jive, our platform (the "Platform"), or in your organization's learning management system (LMS).

We follow the Digital Personal Data Protection Act, 2023 and the rules made under it, and the Information Technology Act, 2000, as they apply to us.

02Our role: it depends on how you use FloGames

Where your organization is responsible, its own privacy notice also applies to you, and it is usually the best first contact for questions about your learning data.

03What we collect

When you browse the Site

Our servers automatically record basic technical information when you visit, such as your IP address, browser and device type, the pages you request, the referring page and the date and time. We use this to run the Site, keep it secure and fix problems.

When you book a demo or leave your email

Your name, work email, company, role, team size, the skills you are interested in, your preferred way to deploy, and anything you write in your message. Name, email and company are required so we can arrange the demo; the rest is optional.

When you contact us

Your name, contact details and what you tell us in your email, call or message.

When you play on the Platform

• Profile details your organization provides or you add, such as your name, work email, an employee or learner ID, team, department or location.
• Sign-in details, such as an SSO identifier, and login times.
• Gameplay data: the choices you make, scores, attempts and replays, time spent, progress and completion.
• Achievements: badges, leaderboard positions and certificates.
• Technical data, such as device, browser and error logs, to keep the Platform working.

When you play in your organization's LMS

The LMS records your progress and scores. We do not receive your name or results, apart from limited technical information if a game's files are loaded from our servers.

What we do not want

Please do not include sensitive information, such as financial, health or identity document details, in messages or free-text answers. The Services do not need it.

04How we use it

We do not sell your personal data, and we do not use it for third-party advertising.

05Who can see your results

• Your organization can see your progress, scores, completion and certificates through reports, as set up under its agreement with us.
• Other players in your organization may see your display name, score and position on leaderboards, if your organization has turned leaderboards on. Leaderboards are not shown to people outside your organization.
• FloGames staff who need it to support and run the Platform.

06Who we share it with

We share personal data only when needed, and only with:

• your organization, for Platform data, as described above;
• service providers who help us run the Services, such as hosting (Amazon Web Services, in India) and email. They may only use the data to provide their service to us, under contract;
• Google Fonts: our pages load fonts from Google's servers, which means your browser shares your IP address with Google when a page loads;
• authorities or others when the law requires it, or to protect the rights, safety or security of users, our Clients or FloGames; and
• a buyer or successor, if FloGames or its business is reorganized, merged or sold, on the condition that they protect the data as this policy does.

07Cookies and analytics

The Site. The Site uses three kinds of cookies and similar technologies:

• Essential. Needed for the Site to work properly.
• Analytics. Tell us which pages are visited, how visitors arrive, the type of device and browser used, and approximate location based on IP address. We use this to understand how the Site is used and to improve it.
• Advertising. Set by us and by our advertising partners to measure how our campaigns perform and to show you relevant FloGames ads on other websites and platforms. These partners may combine this with information they already hold about you, under their own privacy policies.

We do not sell your personal data.

Your choices. You can block or delete cookies at any time in your browser settings. Most browsers also let you block third-party cookies only. Blocking essential cookies may stop parts of the Site from working. You can also manage ad preferences in the settings of the advertising platforms you use.

The Platform. The Platform uses essential cookies and similar storage to keep you signed in and remember your progress. These are needed for it to work, so they cannot be switched off while you use it. The Platform does not use advertising cookies.

08Where your data is stored

Your data is stored with Amazon Web Services (AWS) in India. If it is ever processed outside India, we do so only as permitted under Indian law, and we take steps to keep it protected to the standard described in this policy.

09How long we keep it

• Demo and contact inquiries: up to 24 months after our last contact with you, unless you become a Client or ask us to delete them sooner.
• Platform data: for as long as your organization's agreement with us lasts. When it ends, we delete or return the data as the agreement says, normally within 90 days, unless the law requires us to keep it longer.
• Server and security logs: up to 12 months.

After these periods, we delete the data or de-identify it so it can no longer be linked to you.

10How we protect it

We use reasonable security safeguards to protect personal data, such as encrypted connections, access controls so only people who need data can see it, and regular review of our systems. No system is completely secure, but we work to prevent unauthorized access, loss or misuse.

If a personal data breach occurs, we will act quickly to contain it and will inform the Data Protection Board of India, affected people and, for Platform data, the relevant organization, as the law requires.

11Your rights

Under Indian data protection law, you can:

• ask for a summary of the personal data we hold about you and how we use it;
• ask us to correct, complete or update it;
• ask us to erase it, where we no longer need it or you withdraw your consent;
• withdraw your consent at any time, for example by unsubscribing from emails. This does not affect anything we did before you withdrew it;
• nominate someone to exercise these rights for you if you die or become unable to; and
• raise a grievance with us, and, if you are not satisfied with our response, complain to the Data Protection Board of India.

To use these rights, email our Grievance Officer at Christy@skills.cafe. For Platform data, we may pass your request to your organization, since it decides how that data is used, and help it respond. We may need to confirm your identity first. We will respond within the time required by law.

12Children

The Services are designed for working professionals and are not intended for anyone under 18. We do not knowingly collect personal data from children. If you think a child has given us their data, please contact us and we will delete it.

13Emails from us

If you book a demo or leave your email, we may send you occasional updates about FloGames. Every email includes a way to unsubscribe, or you can write to play@flogames.com. We will still send messages you need, such as replies to your requests.

14Changes to this policy

We will update this policy when our practices change, for example if we change the cookies or analytics tools we use on the Site. The "Last updated" date at the top shows when it last changed. If a change is significant, we will let you know through the Site, the Platform or by email.
